These terms and conditions apply to your access to Westlaw with Preptackle. 

 

1. The material includes temporary access to Westlaw UK to use during practising legal research for QLTS OSCE assessments and attending Preptackle sessions. The access includes Westlaw Overview Articles (previously Insight), Index of Legal Terms Add-On, UK Cases, UK Current Awareness, UK Legislation, UK Legislation PDFs, UK Case Analysis, UK Cases ICLR & SCLR PDFs, UK Historic Legislation, UK Legislation Analysis, UK/EU News, EU Case Analysis, EU Legislation, EU Cases, European LawyerUK/EU Journals and Journal Indices. Any content not expressly included above is excluded.

2. Access can only be used for the purpose of preparation for the OSCE assessments and shall not be used for any commercial use whatsoever. 

 

3. Your access will commence within 7 days of payment and will remain available for a duration of 6 months or until your actual OSCE sitting date, whichever comes first. The duration of your access period cannot be frozen; however, it can be extended for a duration of 1, 2 or 3 additional month(s). In all cases, it cannot be extended beyond your actual OSCE assessment last sitting date.

 

4. You acknowledge that you will not have the right to cancel your order once the access is available to you for the first time.
 

5. Preptackle is not responsible for any technical issues when using Westlaw.

6. Preptackle does not warrant as to the accuracy, reliability or suitability of the Westlaw content, and shall not be held responsible for any errors or inaccuracies found therein, nor shall it be held responsible for any losses suffered as a result of relying on Westlaw content.

7. Your Westlaw access may not be shared, transferred, sold or offered to other parties, nor is it to be used by or made available to any person except yourself. 

8. You shall not be entitled to a refund for fees paid for accessing Westlaw for any reason whatsoever, including (but not limited to) any failure to access or make use of Westlaw.

9. You agree to comply with and be bound by Westlaw terms and conditions as may be in force from time to time which can be found in this link http://legalsolutions.thomsonreuters.co.uk/customer-portal/

10. You acknowledge that in the event that you breach such terms and conditions, or are suspected of having breached them, Thomson Reuters and any third parties who own intellectual property rights in Westlaw, shall be empowered to take action directly against you and you hereby authorise Preptackle to deliver a copy of this contract to Thomson Reuters or the third parties concerned in such circumstances or if requested by Thomson Reuters or the third parties for any reason whatsoever. You further acknowledge that your individual usage of Westlaw is monitored by Thomson Reuters.

11. If either Preptackle or Thomson Reuters should determine that you have violated the policies set forth here or any applicable laws or regulations, each of Preptackle and Thomson Reuters reserves the right, severally, in its sole discretion, to deny further access to Westlaw, without limiting any other rights or remedies each may have.

12. In the event that you breach, or permit another person to breach the policies set forth here, the policies contained within the terms and conditions for accessing Westlaw, or any applicable laws or regulations, Preptackle shall not be held responsible for such breach, or any consequences of such breach, whatsoever. You agree to indemnify Preptackle in full for any losses or expenses incurred by Preptackle due to any such breach.

13. Preptackle reserves the right to cancel your access by written notice with immediate effect. In such an event, Preptackle shall issue a pro rata refund of any fees you have paid in advance for access to Westlaw, within 30 days of the date of cancellation. Subject to the refund, you shall have no other claims against Preptackle.


14. You acknowledge that access to Westlaw may be unavailable in certain countries or geographical regions which are subject to export control or economic sanctions laws and regulations. Such access will also be unavailable from computers or other devices identified as being used in such countries or geographical regions through their IP address. Thomson Reuters reserves the right, in its sole discretion, to update the list of countries and regions in which access to Westlaw is unavailable, and Preptackle shall not be responsible for any lack of access to Westlaw in the event that Thomson Reuters shall exercise such a right.

15. This agreement and any dispute or claim arising out of or in connection with the agreement will be governed by and construed in accordance with the laws of England and Wales. Each party hereby consents to the non-exclusive jurisdiction of the courts of England and Wales to settle all disputes or claims arising out of or in connection with the agreement.
